These Terms and Conditions govern the supply of services by Wastix and apply when you request a quote, make a booking, purchase a service, hire a skip, or otherwise enter into an agreement with us. Please read these Terms carefully before making a booking.

In these Terms, “Wastix”, “we”, “us” and “our” refer to the business identified above.

“You” and “your” refer to the person or organisation requesting or purchasing our services.

2. Our Services

Wastix provides waste collection, rubbish clearance, skip hire and related services as described on our website, quotation, booking or booking confirmation.

The exact scope of the service, including the type and quantity of waste, collection or delivery location, date, price and any specific requirements, will be set out in your quotation or booking confirmation.

Images and descriptions on our website are intended to provide a general indication of our services. Your confirmed booking and quotation determine the specific service we have agreed to provide.

3. Quotes

Unless otherwise stated, quotations provided by Wastix are based on the information supplied to us at the time of the quote.

For waste collection and rubbish clearance services, quotations may be based on photographs, descriptions, measurements or other information provided by you.

You are responsible for providing complete and accurate information about:

  • the type of waste;
  • the approximate quantity or volume of waste;
  • the location of the waste;
  • access to the property;
  • stairs, basements or other access restrictions;
  • whether dismantling is required; and
  • any other circumstances that could reasonably affect the cost or difficulty of the service.

If the actual waste, quantity, access conditions or other circumstances are materially different from those described when the quote was provided, we may revise the price before carrying out additional work.

We will explain any material additional charge before carrying out work that was not included in the original agreement.

Unless stated otherwise, a quotation does not guarantee availability until your booking has been confirmed.

4. Making a Booking

A request for a quote or submission of a booking form does not by itself guarantee a booking.

A contract between you and Wastix is formed when we confirm your booking or otherwise clearly accept your order.

Your booking confirmation will normally state:

  • the service being provided;
  • the agreed date or service window;
  • the agreed price or method of calculating the price;
  • any deposit or advance payment;
  • the service location;
  • the type or estimated quantity of waste, where applicable; and
  • any important additional conditions relating to the booking.

You should check your booking confirmation carefully and tell us promptly if anything is incorrect.

5. Prices and Payment

Prices will be shown or agreed before your booking is confirmed wherever reasonably possible.

Unless stated otherwise, all prices are in pounds sterling (£).

Where VAT applies, we will make clear whether the quoted price includes VAT.

Payment may be required:

  • in full when booking;
  • partly in advance as a deposit;
  • upon completion of the service; or
  • according to another payment schedule stated in your quotation or booking confirmation.

We accept payment using the methods displayed at checkout or otherwise agreed with you.

You are responsible for ensuring that payment information you provide is accurate and that you are authorised to use the chosen payment method.

6. Waste Description and Additional Charges

Our prices depend on the information provided to us about the waste and the circumstances of the collection or skip hire.

If the waste presented for collection differs materially from the information provided when the booking was made, we may revise the price.

This may include circumstances where:

  • the quantity of waste is substantially greater than described;
  • the waste occupies more space than stated;
  • the waste is significantly heavier than reasonably expected;
  • prohibited or restricted waste is present;
  • additional labour is required;
  • access is substantially more difficult than described;
  • additional dismantling is required;
  • the collection requires additional time or equipment; or
  • a skip contains waste that is not permitted under the booking.

We will, where reasonably possible, explain any additional charge before carrying out additional work.

If you do not agree to an additional charge, we may be unable to collect or remove the affected waste.

7. Waste We Cannot Accept

You must not place or present prohibited waste for collection or disposal unless we have expressly agreed in writing to accept it and the necessary arrangements have been made.

Prohibited or restricted materials may include, without limitation:

  • Asbestos or asbestos-containing materials
  • Explosives or ammunition
  • Radioactive materials
  • Clinical or infectious waste
  • Certain hazardous chemicals
  • Gas cylinders
  • Pressurised containers
  • Highly flammable or explosive substances
  • Controlled or illegal substances
  • Contaminated soil or materials
  • Liquids requiring specialist disposal

This list is not exhaustive, and includes other waste that we are not legally permitted or appropriately licensed to transport or dispose of.

If prohibited or restricted waste is discovered, we may refuse to collect or remove it and may charge you for reasonable costs or losses resulting from its presence where permitted by law.

You remain responsible for any prohibited waste that you have placed in a skip or presented for collection.

8. Skip Hire

Where you hire a skip from Wastix, you must use the skip only for the waste types agreed as part of your booking.

You must not:

  • overfill the skip;
  • place waste above the maximum fill level;
  • place waste in a manner that creates a safety risk;
  • burn waste inside the skip;
  • move the skip without our permission;
  • place prohibited or restricted waste inside the skip; or
  • use the skip for any unlawful purpose.

Fill level

Waste must normally remain below the top of the skip and must not protrude from its sides.

If a skip is overfilled or loaded in a manner that makes transportation unsafe or unlawful, we may require you to remove or reduce the excess waste before we can transport it.

Additional charges may apply where a return visit, additional collection or other work is reasonably required because of overfilling or incorrect use of the skip.

9. Skip Placement and Permits

You are responsible for ensuring that the proposed skip location is suitable and that any permission required from the property owner, landlord, local authority or other person has been obtained.

Where a skip is to be placed on a public road or other location requiring a permit, the necessary permit must be obtained before delivery unless Wastix has expressly agreed to arrange it on your behalf.

If a permit is required and has not been obtained, we may be unable to deliver the skip.

Any permit fees or other charges that you have agreed to pay will be payable in addition to the skip hire price unless expressly stated otherwise.

You must ensure that the skip location is reasonably accessible to our vehicle and that there are no obstructions that would prevent safe delivery or collection.

10. Your Responsibilities

You agree to:

  • provide accurate information about the service and waste;
  • provide accurate contact and location details;
  • ensure that we can reasonably and safely access the property or waste;
  • tell us in advance about stairs, narrow access, restricted parking, gates, basements, distance from the vehicle or other relevant conditions;
  • obtain any permission or permit that you are responsible for obtaining;
  • ensure that waste is ready for collection where your booking requires this;
  • use hired skips correctly;
  • not present prohibited waste;
  • follow reasonable safety instructions given by us; and
  • make payment when due.

If we cannot provide the service because you have failed to meet an important responsibility, we may charge for reasonable costs or losses caused as a result, provided those charges are fair and proportionate.

11. Access and Collection Conditions

For collection services, waste should be accessible to our staff and vehicle unless your booking specifically includes additional labour or access arrangements.

Where you have informed us that waste is located indoors, upstairs, downstairs, in a basement, garden or another location, the quoted price may reflect the expected access conditions.

If the actual access conditions are materially different from those described, we may need to revise the price.

We may refuse or postpone a collection where access is unsafe, unlawful or would create an unreasonable risk to our staff, vehicles, equipment or property.

We will discuss reasonable alternatives with you where possible.

12. Dismantling and Removal of Items

Where dismantling is required, this must be disclosed when booking.

Additional charges may apply where dismantling was not included in the original quotation or where the work required is materially greater than described.

Unless expressly agreed otherwise, Wastix is not responsible for reinstating, repairing or making good areas affected by the removal or dismantling of items.

We will take reasonable care when carrying out removal work but cannot guarantee that walls, floors, fixtures or other surfaces will remain completely unaffected where items are fixed, attached or difficult to remove.

13. Delays

Times given for arrival, delivery or collection may sometimes be estimates unless we expressly agree that a particular time is guaranteed.

We will make reasonable efforts to provide the service within the agreed time or service window.

We are not responsible for delays caused solely by circumstances outside our reasonable control, including severe weather, traffic, road closures, vehicle breakdowns, accidents, staff emergencies or other significant disruption.

We will take reasonable steps to minimise disruption and keep you informed where appropriate.

Nothing in this section removes any statutory rights you may have.

14. Standard of Service

We will provide our services with reasonable care and skill.

We will handle and transport waste in accordance with applicable legal requirements and our relevant responsibilities as a waste service provider.

Nothing in these Terms limits your statutory rights as a consumer.

15. Waste Ownership and Disposal

Unless otherwise agreed, once waste has been lawfully collected by Wastix, we will take responsibility for handling and transporting that waste in accordance with applicable requirements.

Before collection, you remain responsible for ensuring that the waste presented to us is lawfully yours to dispose of and does not contain prohibited materials.

You must not place property belonging to another person in a collection or skip without their permission.

16. Problems With the Service

If there is a problem with our service, please tell us as soon as reasonably possible so that we have an opportunity to investigate and, where appropriate, put matters right.

Depending on the circumstances and your statutory rights, an appropriate remedy may include repeat performance, correction of the service, a price reduction or refund.

17. Cancellation by You

If you are a consumer and enter into a qualifying distance or off-premises contract with us, you may have a statutory right to cancel the contract during the cancellation period.

For most qualifying service contracts, the cancellation period ends 14 days after the day on which the contract is entered into.

You do not need to provide a reason for exercising a statutory cancellation right.

To cancel, you must clearly tell us that you wish to cancel using the contact details provided in these Terms.

You may also use the model cancellation form at the end of these Terms, although you do not have to use it.

Services requested during the cancellation period

If you expressly ask us to begin providing the service during the statutory cancellation period, and you subsequently exercise your statutory right to cancel after work has begun, you may be required to pay a reasonable amount for the service supplied up to the point at which you cancel.

Where the service has been fully performed during the cancellation period following your express request to begin early and your acknowledgement that your cancellation right will be lost once the service has been fully performed, your statutory cancellation right may end once the service is complete.

Some contracts may be subject to exceptions to the statutory cancellation rules.

Nothing in these Terms removes any cancellation rights you have under applicable consumer law.

18. Our Cancellation and Rescheduling Policy

Outside any statutory cancellation rights, the cancellation or rescheduling arrangements stated in your quotation, booking confirmation or booking process will apply.

Where no separate policy has been stated, please contact us as soon as reasonably possible if you need to cancel or reschedule your booking.

We will act reasonably when calculating any cancellation charge and will take reasonable steps to reduce avoidable losses.

Rescheduling

If you ask to reschedule, changes are subject to availability.

A change of date may result in a price adjustment where the scope, timing, location or cost of providing the service has changed.

19. Changes or Cancellation by Wastix

We may need to change, reschedule or cancel a booking because of circumstances such as:

  • illness or staff unavailability;
  • vehicle or equipment failure;
  • unsafe working conditions;
  • severe weather;
  • road closures or significant travel disruption;
  • circumstances outside our reasonable control; or
  • information supplied by you being materially inaccurate.

Where reasonably possible, we will contact you promptly and offer an appropriate alternative.

If we cancel a service and cannot provide a reasonable alternative, you will normally receive a refund of amounts paid for the part of the service that we have not provided.

This does not affect any additional rights available to you under applicable law.

20. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that:

  • were not reasonably foreseeable when the contract was made;
  • were not caused by our breach or negligence;
  • arise from inaccurate or incomplete information supplied by you; or
  • result from unsafe, prohibited or unlawful waste being supplied by you.

Where you use our services primarily for personal purposes, we are not responsible for business losses such as loss of profit, revenue, business opportunities or business interruption.

Your statutory rights are not affected.

21. Damage to Property

We will take reasonable care when providing our services.

You should inform us before the service begins of any particularly fragile surfaces, fixtures, structures or other circumstances requiring special care.

We are not responsible for damage caused by pre-existing defects, concealed weaknesses, inadequate access, unsafe conditions or circumstances that could not reasonably have been identified before the work was undertaken.

Where damage is caused by our negligence or breach of contract, your legal rights are not affected.

22. Events Outside Our Reasonable Control

Neither you nor Wastix will be responsible for failing to perform an obligation where performance is prevented by circumstances genuinely outside that party's reasonable control.

Examples may include severe weather, flooding, fire, accidents, road closures, government restrictions, industrial disputes, major vehicle failures or other significant events beyond our reasonable control.

This does not affect obligations to pay for services already properly provided.

If such circumstances prevent us from providing a material part of the booked service, we will discuss reasonable alternatives with you.

23. Personal Information

We process personal information in accordance with our Privacy Policy.

Our Privacy Policy explains what information we collect, how we use it, who we may share it with and your data-protection rights.

24. Website Content

We aim to ensure that information on the Wastix website is accurate and current, but minor errors may occasionally occur.

Nothing on our website constitutes a guarantee unless it forms part of a confirmed booking or is otherwise legally binding.

Unless otherwise stated, the content, branding, graphics, text and other materials on the Wastix website are owned by us or used with permission and are protected by applicable intellectual-property laws.

25. Third-Party Services

We may use trusted third parties to help us provide our services, including payment processors, software providers, waste treatment facilities, disposal facilities, contractors and other service providers.

Where another business provides a separate service directly to you, that service may also be subject to that provider's terms.

We remain responsible for our obligations to you where the law requires us to do so.

26. Complaints

We want to resolve complaints fairly and promptly.

27. Changes to These Terms

We may update these Terms from time to time.

The Terms that apply to a booking will normally be the version in force when the contract was entered into, unless a change is required by law or you agree to a later change.

The latest version will be published on our website with the date it was last updated.

28. Severability

If a court or other competent authority decides that part of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply.

29. No Waiver

If we do not immediately enforce a right under these Terms, this does not mean that we have given up that right.

30. Governing Law

If you are a consumer resident in the United Kingdom, these Terms are governed by the applicable laws of the part of the United Kingdom in which you live, and you may bring proceedings in the courts available to you under applicable law.

Business customers
